Can you tell me if your NHS health board runs any clinics/surgeries in the community that specifically treats patients with a history of violent/ aggressive behaviour? I am writing to you under the Freedom of Information Act to request disclosure of all papers relevant to the implementation of the European Working Time Directive in respect of junior doctors. As you will know this will require the reduction in the maximum number of hours to be worked from 56 hours to 48 hours by August 2009. I am particularly interested to know what plans the Board has to implement the directive as well as what additional costs are likely to be involved. If the Board does not yet have any detailed plans or has only partial plans in respect of some hospitals, divisions or specialities please provide a note of those covered and those not covered. I realise my colleague, Julia Belgutay, has already been in touch with some of you regarding the treatment of patients on the NHS who have already sought advice/treatment privately. For the avoidance of doubt, however, I would appreciate a full, written answer to how the NHS board would respond to a patient in the following scenario. Namely, if a patient pays for a private consultation, including a MRI scan, which reveals the existence of a tumour, what would be the NHS board's position on providing ongoing treatment and what advice would be given to the patient? It is very important to have clear guidance on this before we publish. It would seem reasonable that there can only be three answers That the patient is automatically eligible and his initial treatment is not a bar to NHS treatment and, therefore, simply not an issue. That the patient's private treatment would be considered an automatic bar to NHS treatment. Or, that the patient's private treatment MAY exclude him/her from treatment on the NHS. If this is the case, we need to know on what basis this individual may be denied NHS treatment. The generic responses we have had so far cloud the issue. To ensure what we print is fair and accurate, I would ask that you indicate which of the above three scenarios best reflects the NHS board's position. I would also like guidance on the provision of medical care paid for under a patient's private company medical insurance. If a patient is made redundant while receiving NHS care, is it the case that private medical companies still honour the costs? If not, are the costs picked up by the NHS?

Under the terms of the Freedom of Information Act I would like to request the following information concerning all new outpatients who received a non-urgent neurological MRI scan from 1st March 2008 to 31st May 2008: a) the date of appointment with GP at which referral to a neurologist was made (if applicable and if available). b) the date of appointment with clinical neurologist at which referral for an MRI scan was decided) the date on which referral for a neurological MRI scan was received and officially logged i.e. the moment at which the 'waiting time' begins d) the date on which the first MRI scan was carried out. In response to Michael MacLeod's recent article in the Sunday Mail re 'lost' patients. NHS Lothian has reported that no patient has ever absconded from open wards. To clarify this point under the Freedom of Information (Scotland) Act 2002 I would like to know for the last financial year: How many mental health patients have absconded from wards without permision i.e left the ward without permission? An abscondee does not need to be a patient under Mental Health Legislation as volunatry patients can also been deemed abscondees. Mr Boyter's letter stated that the minutes of the meeting of 14 May 2008 (to which Dr Wall's application on my behalf of 14 May 2008 was presented) with confidential information shielded, were enclosed. However, I could find no reference to my own case (although I understand that the minutes do not, contain details of the results of applications). Is there an omission I can be privy to? Also, I could find no reference to the names and specialities of the committee members - which is a normal component of any meeting minutes. Is this information available? Was a consultant oncologist present at the meeting? I appreciate that there is no common standard national application procedure and that each of the 131 PCTs have their own procedures. I also understand that it is quite normal for the patient's consultant to make application or request specific information on behalf of the patient. I was therefore surprised when, following the, 17 June 2008 letter to Ms Elizabeth Preston from my consultant, Dr Wall, requesting specific information regarding the refusal of my application, I was told that it was necessary for me to write personally -which I did on 1 August 2008 in essentially the same terms as Dr Wall. With respect, this appears somewhat bureaucratic. Is there a particular rationale for this procedure?

I would therefore be very grateful if you could advise me as to how many deaf children NHS Lothian is currently providing audiology and speech and language therapy services for in my constituency. Specifically, I would be interested to know how many children have been diagnosed with a hearing loss via the Universal Newborn Hearing Screening tests since 2005, and whether NHS Lothian is currently continuing with school-entry hearing tests for older children in my constituency. In an article in Nursing in Practice, "Care over drugs may cut death rate", Tuesday 22nd July 2008, there was a reference to a list of broad spectrum antibiotics to avoid. This was referenced as published by NHS Lothian. "Dr Dermot Gorman, public health consultant at NHS Lothian, said: "Doctors are asked to be careful with prescribing antibiotics and to think whether patients need powerful broad spectrum ones. The BBC is making a series of programmes about the NHS to be broadcast in the Autumn. One of the programmes includes a section on expensive high end drugs, for things like stage 4 renal cancer or bowel cancer etc. Drugs which are sometimes requested by patients, or prescribed by doctors, but which because SMC has not yet published guidelines on, may not automatically be funded by health authorities. We are trying to find out which drugs are funded in which areas. We have selected 4 drugs, suggested to us by a top Oncologist. The Muscular Dystrophy Campaign is currently working towards raising the standards of care and support for people with neuromuscular conditions across the UK. There are more than 60 different neuromuscular conditions and we believe that a comprehensive, multi-disciplinary service is required to meet patients' needs. I am writing to all Local Health Boards to help build up a picture of access to services for people with neuromuscular conditions in Scotland. As you may have seen, the Scottish Parliament's Public Petitions Committee today issued a report which touched on the issue of NHS patients being forced to pay for some of their own drugs, and then forfeiting the remainder of their NHS care. The report was prompted by the case of Michael Gray, who was obliged to pay for Cetuixmab for his bowel cancer as NHS Grampian initially refused to supply it. Mr Gray was then obliged to pay an additional £2700 a fortnight for the NHS care he had hitherto been receiving for free. REH Expenditure – can I work on the assumption that although it is mentioned that £4million is being spent over the next four to five years that is not the same £4million and does in fact mean that £8million is to be spent spread roughly between half on infrastructure and half on general ward upgrading? Since the business case for the expenditure of £8million has not been finalised I can see it is difficult for you to answer my question of 21 March with regard to phasing of expenditure. When a hospital department is carrying out a clinical trial, must the doctor inform and gain consent from the patient who has been sent to the department for other reasons, before interviewing the patient as a possible subject for the trial? Are there any particular rules regarding patients who are considered 'vunerable' without social support, say not health reasons. Should the clinical trial be mentioned in the letter sent to patients attending the department for other health assessment or second opinions. Is consent needed for release of the patient's medical records for any review required by the clinical trial doctor. I have been perusing the NRIE contract papers which you successfully mounted on the web. Among the papers is a letter from Ryden regarding the sites agreements for the PMR Hospital, the City and the Dental Hospital giving their opinion that the agreements for the site disposals are on a true commercial basis. It is clear from other papers by advisers to the Lenders that Rydens had actually given valuations to the Trust. These valuations however are not in the contract papers displayed on the web. Nor is there any paper which shows what advice was given on indexation of the land values. Under FOI can I please have this information.

Information pertaining to the use of electric shock treatment (referred to as E.C.T.) in Edinburgh, specifically what sites use this treatment and the number of patients to have been treated using this method each year for the last 10 years. I'd also appreciate the names of the clinicians involved in administering this treatment. Information on acute psychiatric care. If a patient were to be sectioned under the Mental Health Act for a serious/ violent offence, which hospital/ secure unit would they be taken to?
